Do Rob Kardashian & Blac Chyna Share Custody Of Dream?

Following Rob Kardashian's social media tirade against ex-fiancée Blac Chyna last Wednesday, fans expressed sympathy and worry for the couple's 8-month-old daughter Dream. Now that it's possible Kardashian could have violated California's revenge porn laws when he released nude photos he claimed were of Chyna allegedly without her permission, fans are more concerned about Dream than ever. Given the high stakes involved in Kardashian and Chyna's volatile relationship, it makes sense people are curious about Dream's custody arrangements. So, do Rob Kardashian and Chyna have joint custody of Dream? Kardashian's representative did not immediately respond to Romper's request for comment regarding allegations about revenge porn or allegations that he defamed Chyna. He currently does not face any formal charges, though Chyna's lawyer Lisa Bloom, said she and Chyna would appear in court Monday to file a restraining order against Kardashian.

As fans already know, Kardashian hurled a number of mean comments and allegations against Chyna during his online tirade. One of those hurtful promises was his vow to never let Chyna see Dream again due to her alleged use of "alcohol and drugs and cocaine and X and E," according to E! Online. Although these allegations have yet to be proven in a court of law, Chyna is in a tricky predicament because she doesn't have a formal custody agreement with Rob.

According to People, Chyna and Kardashian currently have an informal and unwritten custody agreement for Dream. The agreement allegedly dictates Kardashian is to have custody of Dream Sunday through Thursday while Chyna gets her Thursday through the following Sunday, according to People. Unfortunately for Chyna, an insider claims Kardashian did not return Dream to Chyna on Thursday as planned, according to the report.

A source told People:

They have have two nannies, one works five days a week and one works two days a week. The five-day-a-week nanny does the pick up and drop offs. The baby is supposed to be with Chyna per their agreement — which isn’t written, just what they’ve been doing for the last six or seven months — and she is not. Chyna is doing everything in her power to get her back.

Taking a look at Chyna's Instagram account, the last the time she posted about Dream was six days ago. In the sweet post, Chyna referred to Dream as her "Poom Poom Nugget," a moniker she adorned with two pink heart emojis. It's unclear at this point if Dream has been returned to Chyna or if she's still with Kardashian.

As for whether Kardashian can actually take Dream away from Chyna, family law attorney Alyssa Eisner told People:

Nobody has a superior right to this child because there’s nothing in official writing, so no one has been provided custody. Their de facto arrangement is not law, so the courts would consider that but also look to see what has been the change in circumstance that now brings one of them to court. For example, these pornographic images or allegations of abuse or orders of protections.

Although Kardashian has yet to release a statement regarding custody of Dream, TMZ reported that he hired lawyer Robert Shapiro to assist him with formal custody arrangements. Per the report, Shapiro will bring up the issue of custody while defending Kardashian against Chyna's request for a restraining order. Shapiro is set to appeal to a judge sometime on Monday, according to TMZ.

It's no secret that custody battles are tough, especially when they're drawn out in the public eye. Going forward, hopefully Kardashian and Chyna can come to a formal agreement that protects Dream in the long run. Although an informal custody agreement made sense to Chyna and Kardashian at the time, it's now clear their decision has put Dream in a precarious and sad situation.
